NDIS Appeals

NDIS Appeals (formerly known as External Merits Review) allows individuals who have applied and been declined for the National Disability Insurance Scheme (NDIS) a means to disagree with that decision and seek follow-up.

RIA provides non-legalistic advocacy services acting in a ‘support person’ role to eligible applicants who meet all five eligibility criteria, and;

  • RIA’s Intake Coordinator has appropriately assessed the participant; and
  • There is a legitimate need to access independent supports if the participant does not have the capacity to self-represent; and
  • There are no natural or informal supports to advocate on behalf of the person with disability (participant)

In some instances, and only when resources are available, RIA can act in a support (person) role and provide advocacy assistance for:

  • An appointed adult guardian, plan nominee of people with disability including carers, family members or spouses of a person with disability; and
  • The family member, carer, spouse or guardian requires assistance and advice on how to put the participants case forward (for a review of NDIA decisions); will
  • RIA action a referral to the NDIS Appeals Legal Clinic, and the participant’s application be independently assessed by the Legal Aid Commission
  • Assist applicants to navigate the process including collation of documents, attending case conferences and hearings, as required
